Viewer > Edit menu
following commands are always enabled:
- Select none
- Selection - swap width & height
- Selection - set size > Save selection



Suggestion
disable mentioned commands if there is no selection
(same behavior as 'Print selection...' and 'Save selection...')

Thanks to your detailed description I can reproduce the problem.

This problem is supposed to be fixed in XnView MP 1.8.1. Please check and confirm the bug fix here.
